Foreign investments in critical sectors - Proposal for amending the law: May be subject to state control
MP Eduard Shalsi has proposed amendments to the law "On Foreign Investments", aiming to add a control mechanism for investments related to strategic and sensitive sectors for the country.
Specifically, the proposal provides for the addition of a new paragraph to Article 10 of the law, according to which foreign investments affecting critical public infrastructure, critical technologies, supplies of important goods or access to sensitive information may be subject to an assessment or examination process by state authorities.
Investments related to critical public infrastructure include energy, transport, water or digital networks. Also included are investments related to critical technology and dual-use goods, i.e. civilian and military, the supply of critical inputs, access to sensitive information or on media freedom.
These investments, according to the proposal, may be subject to a special evaluation process, according to rules approved by Decision of the Council of Ministers.
Similar practices are already in place in European Union countries, where foreign investments in areas such as technology, digital infrastructure or media are monitored for potential impact on public order and security. Meanwhile, experts suggest that any control instrument be accompanied by clear guidelines, procedural transparency and defined time frames for review, so as not to discourage valuable investments in sectors important for the country's economic development.
