Cyber attacks, AKSK takes on investigative role - New intelligence group with SHISH, army and Ministry of Interior
Cybersecurity is expected to become part of national security. The draft law on some additions and amendments to the law "On Cybersecurity" provides for strengthening the role of the National Cybersecurity Authority, giving it broader powers in coordination, supervision and response to cyber incidents.
One of the most important changes is the role that AKSK takes in cases where a cyber incident is suspected of being related to cybercrime or other criminal offenses. In these cases, the Authority will coordinate with the State Police and law enforcement institutions for the collection and preservation of evidence, as well as for the technical investigation of the incident.
The draft law also provides for the establishment of an Inter-institutional Cyber Intelligence Group. This structure will include the National Cyber Security Authority, the Ministry for Europe and Foreign Affairs, the Ministry of the Interior, the State Intelligence Service, the General Staff of the Armed Forces and the Defense Intelligence and Security Agency. This group will be tasked with exchanging early warning information on cyber threats, assessing their impact on national security, the economy and public services, as well as drafting periodic bulletins on cyber threats.
Meanwhile, operators of critical and important information infrastructures will be required to declare how their systems are stored and maintained and how they are managed. They will have to provide information about the entity that manages the technological infrastructure, its location, security measures, and the use of cloud services or virtualization.
Operators will be required to self-declare technical, organizational and operational cybersecurity measures. According to the draft law, the information provided must be accurate, complete and up-to-date.
The draft law also provides for administrative measures for failure to comply with these obligations. Fines range from 1 million to 10 million lekë, while failure to submit a self-declaration of cybersecurity measures within the deadline is expected to be punished with 5 million lekë.
The implementation of the changes is also expected to have budgetary costs. According to the report, the establishment and operation of the sectoral Cybersecurity Incident Response Team could cost around 350 to 450 million lek per year in its full phase, while for 2026 the financial effect is predicted to be 120 to 150 million lek.
