Businesses will manage their own waste - Obligations/ Finance collection and recycling. "Salty" fines if not met
Every manufacturing entity that develops, produces, processes, treats, sells or imports products that generate waste after use will have obligations to manage them.
The draft law that aims to establish the Extended Producer Responsibility scheme has arrived in the Parliament for discussion, specifying that the application of this scheme is an obligation that must be fulfilled by our country in order to join the European Union.
The law will apply to specific waste streams, which are: packaging and its waste; batteries and accumulators; end-of-life vehicles and waste electrical and electronic equipment.
Meanwhile, the main obligations of the manufacturer are related to financing and creating a system for the collection, transportation, recycling or another way of treating waste generated by their products that they place on the market in Albania.
Investments in collection infrastructure or the development of appropriate information, awareness, guidance or training activities to inform citizens in exercising their rights as consumers will also be mandatory.
All costs arising from fulfilling these legal obligations will be covered by producers, reducing the burden of waste management for the state.
According to the draft, administrative measures will also be imposed in case of non-fulfillment of obligations by entities. The proposed fines range from 100,000 to 1,000,000 lek.
The legal obligations arising from this law will take effect on June 1, 2026. The draft law was first released for public consultation in October 2023 and envisaged the start of implementation in 2025, but only now has the draft been sent to the Assembly.
The new version also provides for a halving of the fines that will be applied, compared to the document issued for public consultation.
