Procedure/ How will invoices be issued by producers? - Taxes: Here are the cases when farmers are not obliged to declare income
While a day ago, the field action was launched to verify the fiscalized invoice of taxpayers who engage in the trade of agricultural and livestock products, both wholesale and retail, the tax administration has clarified the procedure for how invoices are issued.
Through an official announcement, the General Directorate of Taxes clarifies that for the correct issuance of these invoices, taxpayers must follow several steps:
Select the "autoinvoice" option, which automatically contains the data of the buyer issuing the invoice; The invoice type must be "Purchase from domestic farmers" (Domestic); Enter the data of the selling farmer (name and NIPT) and describe the goods purchased, excluding VAT.
To verify the accuracy of the transaction and the origin of the goods sold, it is recommended that the invoice be signed by the seller (farmer).
The Tax Administration brings to the attention of taxpayers in this sector that in order to be subject to compensation, they must meet the conditions to be registered as a "farmer".
Also, the annual turnover must not exceed the minimum VAT registration threshold; To supply goods or services derived from their work, carried out in one of the specified activities; These goods and services must be supplied to taxable persons who do not benefit from the compensation scheme; To be provided with a NIPT from the Regional Tax Directorate where the agricultural producer carries out their activity, without being subject to the obligation to declare, according to the VAT law.
Taxes clarify that the category of farmers registered with the Regional Tax Directorates is not obliged to keep accounting records, declare and submit to the Tax Administration the Declaration and Payment Form for Personal Income Tax from Business or the Annual Personal Income Declaration for income generated from the farmer's activity.
As above, the income generated by these farmers is business income, so the farmer does not bear the legal obligation to declare it. The total value of the income generated is the data according to the purchase invoices issued by the agricultural collectors.
If the annual turnover exceeds the limit of 10 million lek, the agricultural and livestock producers (farmers) must be deregistered from the tax authority and registered as taxpayers at the National Business Center, receiving a new identification number.
As for other agricultural producers, who are not registered as beneficiaries of this compensation scheme or who do not trade agricultural products to agricultural collectors, they bear the obligation to register and declare the income generated in the same way as other taxpayers.
