“Early release on parole for life-sentenced prisoners”/ The draft of the New Penal Code is discussed. Manja: The need for an evolving state
The first public discussion on the draft of the New Criminal Code of Albania has taken place. This Code represents a conceptual reformulation and reformulation of Albanian justice, combining legal modernization with the humane principles of restorative justice.
According to the Minister of Justice, Ulsi Manja, the New Criminal Code should have the 1998 Constitution as its constitutional basis.
" The current Criminal Code was adopted in 1995, at a time when Albania had just emerged from the totalitarian regime. The request to have a new Criminal Code is a need of a state that is evolving. The 1995 Code that we have in force had 285 articles and 550 paragraphs, while today it has 327 articles and over 750 paragraphs. They have been frequently amended in a fragmented manner. The current Code no longer responds to the challenges of the time and its implementation presents real difficulties for judges, prosecutors and lawyers. Conceptual and structural reformatting is not only necessary, but inevitable ," said Manja.
The Director of the School of Magistrates, Arben Rakipi, was the head of the working group for the drafting of this new Code. He stated that among the innovations of this Code is the early release on parole for persons sentenced to life imprisonment.
" Early release on parole. We have had several obstacles related to the application of parole for life imprisonment. Finally, the long discussion is that we can apply parole for life imprisonment. It is a very bold proposal, the debate has been strong because many things are involved here, some of which I mentioned, social peace, victims, public order, the level of criminality, etc., but based on the belief that I personally have, that people change and improve if the work with them is effective. This is not a slogan said because of my training, but a daily experience that happens everywhere, so we finally proposed this solution ," - declared Rakipi
The working group for drafting the new Code was established in 2023. This Code comes at a time when new forms of criminality have emerged, and many elements have been added related to environmental, financial crime, victim protection, and others. The Criminal Code was also drafted in the context of the approximation of Albanian legislation with that of the European Union.
