Postponement of owners' compensation is requested - The draft law is ready, the deadline for the distribution of financial values until 2028
It is published for Public Consultations, the draft act for the re-opening of the deadline for reviewing the owners' requests in the administrative way by the Property Handling Agency until 2027 and the postponement of the deadline for the distribution of the value of the financial compensation until 2028.
The purpose of this draft act is to give citizens the opportunity to have their requests examined administratively by the Property Handling Agency in a shorter time compared to the time that would be spent in case of their examination by the judicial jurisdiction.
But what are the factors that have influenced the postponement of the deadline?
According to the report, the factors are that in accordance with law no. 133/2015, as amended, the Property Handling Agency is responsible for the implementation of decisions when they take final form in terms of the law, as regards the financial evaluation of the right of compensation or for the execution of the assessment according to the court decision. Another factor remains the backlog of files with the judicial system.
Meanwhile, the progress of the court proceedings and the attitude of the courts, which as far as the treatment of requests for recognition of ownership is concerned, have not proceeded in all cases with the financial evaluation of the recognized right, the postponement of the deadline for the financial evaluation until 2027, creates the conditions for the financial assessment of executive judicial titles by the ATP.
In relation to the decision-making process, ATP has currently completed the administrative procedure, taking a decision on 115 files or 1.6% of the still pending requests, while it has started the notification procedures for completing the documentation for about 2900 requests for ownership recognition or 41.4% of the files. / practices. According to legal forecasts, the compensation fund of 50 billion ALL is distributed over 10 years after the entry into force of the law, i.e. until 2026.
