Volunteering in Albania, new rules and legal protection - Booklet and contract for every volunteer, here's what the law provides
The Council of Ministers has approved the draft law "On Volunteerism", which engages citizens free of charge. But what is foreseen in this legal act?
At its last meeting, the Council of Ministers approved the draft law “On Volunteerism”. Volunteerism is the free-will investment of time, knowledge and personal skills in the performance without compensation, directly or in an organized manner, of works or services for the good and interest of the public or for the benefit of other persons. Volunteerism is organized in the form of long-term volunteerism and short-term volunteerism.
This law applies to all entities that perform, offer or benefit from volunteering in the Republic of Albania. It does not apply to the performance of work or services that are common in the family, society or in neighborhood relations, blood donation, the fulfillment of certain obligations by final court decision, engagement in a training or professional formation program, prior to the conclusion of an employment contract.
According to the draft law, providers of volunteering can be public institutions, religious communities, non-profit organizations and even businesses that do not aim to make a profit in this activity. Beneficiaries of the work of volunteers can be individuals, public institutions, non-profit organizations or religious communities. On the other hand, the decision states that volunteering should not be used to replace regular employees or services that are normally paid, but it also emphasizes that the use of volunteers for economic gain is prohibited.
The law also clearly defines the rules on their social security obligations. According to the law, volunteers are exempt from the obligation to pay mandatory social security contributions, except for insurance against accidents and occupational diseases. Volunteering is carried out without monetary compensation, without compensation in kind or any other form of material benefit, during the duration of volunteering or upon its termination, unless otherwise provided by this law. According to the law, the volunteer will be provided with a volunteer booklet and contract.
