ICT services will be classified according to complexity - New margins for cybersecurity services in the administration

The Council of Ministers has approved the decision "On determining the rules for payments for services provided by the company "Albanian Digital Solution", sh.a., to beneficiary public institutions, establishing the new framework for the financing of information technology and cybersecurity services in public administration.
The decision determines the principles, procedures and methodology for calculating payments that public institutions will make to the company "ADS", sh.a., for services such as the development and maintenance of electronic systems, the administration of digital infrastructures and the implementation of cybersecurity measures.
An important part of the decision is related to the classification of services according to their financial value and level of complexity. The services will be divided into four categories, starting from projects worth up to 50 million lek, to projects exceeding the value of 350 million lek. In parallel, each service will also be classified according to its technical and operational complexity, at levels from “low” to “very high”. Based on this classification, the operating margin that the company “ADS”, sh.a. will apply will also be determined. According to the decision, this approach aims to avoid disproportionate profits and guarantee efficient use of public resources.
A special treatment is foreseen for cybersecurity services. For these services, when they constitute the main subject of the contract or are offered as specialized services, a fixed operational margin of 20% will be applied. This treatment is related to the highly specialized nature of these services, the high level of operational risk and the technical requirements they entail.
According to the decision, the payments are not considered public fees, but contractual payments for specific ICT services. The new procedure provides that public institutions first submit requests to the National Information Society Agency (NAISA), which will conduct a preliminary review and then forward the request to the company “ADS”, sh.a.
Existing contracts for ICT services will continue under current conditions until their termination, while new services will be treated according to the new rules approved by this decision.
