Competition and transparency in tenders/PPA, institutions: No unnecessary criteria and unjustified shortening of deadlines

Public institutions should show increased care in preparing tender documents, clearly arguing each required criterion and linking it directly to the object of the contract. The request comes from the Public Procurement Agency, which emphasizes that cases have often been identified where authorities have set unnecessary, unreasonable or disproportionate criteria, which limits the participation of economic operators and competition in the market.
A recent PPA recommendation states that requests for manpower, technical means, certifications or professional licenses should be based only on the real needs of the contract, supported by technical analysis and legal reasoning. The PPA also urges contracting authorities to avoid requirements that are not related to the subject matter of the procurement, as well as imposing unjustified obligations regarding the number of personnel or previous experience.
Another important element of the recommendation is the issue of deadlines for the receipt of bids, where the PPA warns that unjustified shortening of the legal deadline can lead to restrictions on competition and transparency. The document emphasizes that procedures must respect the minimum deadline provided for in the law, except in special cases when there is a truly justified urgency.
The PPA also stops at procurements above high monetary limits, where tender documents must be drafted in Albanian and English, as well as at requests for the submission of samples or authorizations from manufacturers, requiring that these be used only when technically justifiable.
