Is there a shelter for foreigners employed at home? - Muçaj: The Labor Inspectorate has no right to inspect the apartment
The employment of domestic workers in Albania is entering a clear legal framework for the first time, aiming to formalize a sector that has operated partially informally for years. With the latest changes, a special category for “domestic workers” is created, with a specific visa and a unique permit that combines the right to stay with that of work.
Eljo Muçaj Chief Inspector of the State Inspectorate of Labor and Social Services:
"I'm starting the answer from the second part of the question, are there violations in this target group of employees? There have been violations and we have faced them and tried to treat them within a legal framework that can investigate cases of this nature. Since these workers are mainly domestic workers, the Labor Inspectorate does not have the right to inspect the apartment, because their place of work is the apartment where they exercise their activity, where they practice their profession. Even in cases where complaints have been received, which are complaints from foreign employees working in domestic conditions, their communication has been in the form of advice via email, telephone. In cases where these employees have been contracted through mediation agencies that have been brought in, we have conducted inspections at these agencies."
According to him, in cases where undeclared employment is found, liability and sanctions depend on the form of the contractual relationship and the role of intermediary agencies.
"It is assessed on a case-by-case basis, if the mediation office is in a contractual relationship. The sanction goes to them, but there are also legal issues to be clarified because the contract of the relationship that is made between the parties must be assessed and in what form the responsibility is discharged and who bears the responsibility. The violations that have been identified in this target group of employees are violations related to working conditions or working hours that are not very serious violations, but which are important violations that need to be addressed because everyone has the right to work based on the rules. The sanction is a form that we use when we have exhausted all other forms and have passed the counseling and warning phase because that is the spirit. "
By integrating this category into e-Albania's electronic forms and requiring a regular employment contract, the authorities aim to make the process traceable and reduce undeclared work.
